Question regarding online marketplace

Me and my buddy have come up with an idea to make a website that allows users to sell items and make purchases. (Like eBay, but much different.)

We aren't sure what the legal aspects are in running a business like this, and what needs to be taken care of in order for this to happen. Anyone have any experience in this area?
