I have the task of developing the specification for a new web site for my organisation. The existing site is outsourced to a design and development company, as the new one will be, although on a different and more flexible basis. The existing domain name is to be retained. What legalities and procedures are involved in doing this?

That is just a tad confusing...you need help on moving the site, deleting it, or what?

The design company that did the existing site will have to be asked to delete it from the hosting company's server (I don't have access to all the files, so can't delete it myself.) I have the documentation regarding the purchase of the domain name, which can be passed on to the new design company. Do I need to do anything else?

Sorry if I wasn't clear.

so your not changing hosts, providers, ect?If no, then you should be done!

I imagine we will use a different hosting company, as our present one has been rather uncooperative and user-hostile :-(

If you switch to a new hosting company, you won't need to worry about the old site files. They will be inaccessible to the public, and deleted by the old host when the account is terminated. Secure the new host, then give the new design company the login info for:
1) The original registrar site, so they can change the nameserver info (I'd actually consider keeping this info in-house, if you can. Changing the nameserver settings is very easy.)
2) The new hosting company, so they can upload the new site files.

Not sure what to tell you re: legalities. Probably best to consult a lawyer (barrister?).
