Legal issues surrounding usage of images

What are the legal issues surrounding usage of a image that is pulled of another site. Must a release be obtained from the photographer/web content manager?

If I'm correct and by 'Orlando' you mean 'Orlando, Florida' or other fine metropolus in the United States then there are some Federal accessibility laws that apply to images in general that are posted on the internet.
