    How to report a developer

    Hi everyone,

I hope you can come me out of the situation that I have encountered recently with a web developer.

I am just about a business and needed a developer to Translate the theme of my brand into my website with theme colours etc.

I sending lots of developers emails stating what I needed and I eventually hired a developer from Ireland and explained the situation. Although I am in the UK she's suited my needs better so I decided to continue.

I stated what I needed to be done, and I signed a contract with her. Due to my disability I became very unwell and it took me a long time to get everything sorted so she could start work.

She asked me 100% of the payment to continue. I paid 120. For two hours of work in which she believed she could get the translation of my brand into the website.

After reviewing her work I was actually shocked to find that she completely transformed the homepage which I did not require. I then with my experience of web development of WordPress had to change back to how I wanted to it to be viewed.

She also did many small things like to take a logo away, add some text, edit some text etc not really what I wanted. She also only focused on the homepage. Many other things are a problem.

She also message me that she needed more files in order to complete the rest of the website from my brand designer. By the time I had these files ready she then emailed me and said that she was extremely ill and could not continue with the project.

After stating all of the issues that I had found, I asked for a partial reimbursement. As I believe it is only fair that I had to revert the homepage back to its original look. Furthermore I have now to find a different designer where continuity would be lost. Also looking through what she had done on the website she had hardly done anything.

I have emailed her and stated that I'm not happy in which she denied everything and I have now emailed her back picking out the terms and conditions in which she failed such as 100% of the payment, akin to pressurising me.

I'm writing here today to ask if there is a way to legally report her and somehow claim my money back?

    Kind regards,

Sorry if I have been a bit unclear just let me know which points to clarify

Do you have a written agreement on what needs doing? A record of a contract for that purpose outline the scope or limits of work to be undertaken.

If you did tell the developer to not do certain things and they did it anyway, then you do have reason to complain, the work has to be redone to your spec at their cost as they have already been paid for the work, they have a to by your rights under the consumer rights act and under SOGA in the legislation to provide said goods otherwise it is seen as fraudulent trading,

So you can in this instance, with your evidence, go to the county court, get a form to register your complaint, there is a fee, then its up to the developer to then answer to the courts.

You should ensure that you add in your complaint that you want the fees to be waived or paid by the respondent as well as that you can add in costs for all paperwork that you need copied and state clearly the remedy you want. IMHO this would be a straight forward case of getting your money back.

If the case goes against the developer, then there will be a public record of that fact and trading standards may want to have a look at all their dealings in the past.

Put your complaint in writing, post it SIGNED FOR service so you get a signature off the Royal Mail postal service.
in the letter give the developer 28 days to respond with a refund or you will be taking further action.

DO NOT SAY WHAT, just leave it at that, if you have not had anything in the post by day 29, then file your paperwork and even if it happens to be that the item was delayed, tough, they had more than enough time to respond, so let them try that game with the court.

Now I do believe that 120 is large enough to be logged on your (rather their) credit report for about 6 years... bad for them...

    Good Luck.

If you can't think outside the box, you will be trapped forever with no escape...
